If you're suing him within a civil court (which you are), I'm sure you know that you have to be in THEIR jurisdiction (their county/state/country) in order for that case to go through. So, are you REALLY suing him?
Your so called "lawyer" obviously doesn't know the law and court system quite well. Any lawyer would have told you that you would have to make travel arrangements to the defendant's court (in his county/city/state.)
More than likely your piddly PSDs were probably not going to be worth the cost of a.) your "lawyer" (hell, the cost for the lawyer alone can be upwards of $1,000+. Although according to your claims, it sounds like you hired on someone that's never even gone to law school) , b.) traveling and lodging in his location, and c.) risking losing the small claim.
But back to the claim of your suing him, I'm going to call bull****:
Los Angeles Superior Court - Small Claims
Where Can You File Your Claim?
You must sue in the right court and judicial district. This rule is called venue. If you file your claim in the wrong court, the court will dismiss the claim unless all defendants personally appear at the hearing and agree that the claim may be heard.
The right district may be:
* Where the defendant lives or where the business involved is located;
* Where the damage or accident occurred;
* Where the contract was signed or carried out;
* If the defendant is a corporation, where the contract was signed;
* For a retail installment account or sales contract or a motor vehicle finance sale:
o Where the buyer (defendant) lives;
o Where the buyer (defendant) lived when the contract was entered into;
o Where the buyer (defendant) signed the contract;
o Where the goods or vehicle are permanently kept.

And WTF @ tehJ -- You post in this thread with work you want him to do, and then someone posts that he's filing a small claim against the OP. Then you post after viozz saying that he did the same thing to you, hell, you even go on to say that the OP deserves it. What the ****? Seriously, are you mentally impaired?

ok mister smartass, i've got no idea why you should call me "mentally impaired" i don't see any reason for this
ShaneJ contacted me on MSN saying my template was perfect for him to get back into coding, after a few days i PM'd him here on TF and went to check his post, thats when i saw viozz's post about being scammed aswell.
I posted "he did the same to me" so people know this person is not to be trusted, btw tell me Jordanriane, doesn't a scammer 'deserves' to be punished? or do you approve what he did?

tehJ, that'd be Misses Smartass to you, and anyone else.
Regardless, I don't feel sorry for you or the other r-tard that posted in this thread for him to do work. If you took the time to read you'd have seen that he isn't setting up timeline for his work, therefore he could get back to you whenever he pleased. What did you expect, him to rush to your needs immediately when you started to bug him?
If you want work done, pay for it from a reputable source. Not someone doing it for free on a forum, especially when he says that there will not be a timeline.
I shall go play the smallest violin for you.

If you're interested, I can code your website (as long as it's html / integration work) with a 2 day turnaround, I've got past work and testimonials if you'd like to see them. I'll quote you upon seeing the design.

So what happened to your so-called claim of suing him? It's so easy to bull**** on the internet and get caught being a moron at it.
